GENERAL TERMS AND CONDITIONS OF PURCHASE

(“General Conditions”) 

​1. FOREWORD

These General Conditions have as their object the purchase of artworks ("Works") offered by Art Gallery Camilla Carè ("Gallery"), located in Via Augusto Dulceri 46, 00176 Rome.

Each purchase will be governed by the rules of the Civil Code and the Consumer Code, where applicable, and by reg. (EU) 2016/679 regarding aspects of privacy and processing of personal data of the customer ("Customer").

 

2. PURCHASE OF THE WORK

The purchase of the Work is complited upon receipt by the Gallery of the confirmation of the payment made by the Customer in the shopping area of the website www.spaziogomma.com ("Site"). 

The purchase implies that: i) the Customer has read and understood all the instructions written on the Site regarding the procedure to be followed; ii) the Customer has read, understood and accepted these General Conditions. 

 

3. PROCEDURE FOR PURCHASING THE WORK.

The Customer may purchase the Work at the price indicated on the Site. 

If the Customer does not opt for free pickup of the Work at the Gallery, located in Via Augusto Dulceri 46, 00176 Rome, the delivery cost will be added to the purchase price. 

The delivery will be made by express courier to the address indicated by the Customer during the purchase procedure. 

Before proceeding with the confirmation of the payment, the total cost the Customer has to pay will be summarized.

 

4. PAYMENT METHOD

The Customer must proceed with the payment of the Work in advance by using the method chosen in the shopping area of the Site: credit card (Visa, Visa Electron, MasterCard), Paypal or bank transfer.

 

5. CUSTOMER'S OBLIGATIONS 

The Customer is obliged to verify that: i) the package is intact, undamaged, and not wet; ii) the Work inside the package is undamaged. 

If the Work inside the package is damaged, the Customer has 24 hours from the delivery date to contact the Gallery at info@spaziogomma.com in order to receive instructions by e-mail for the return of the Work and to start the procedure for the reimbursement of advanced payment. This procedure must necessarily be accompanied by photographs attesting very clearly the damage found.

 

6. TIME FOR ORDER PROCESSING AND POSSIBLE RETURN 

The Gallery will diligently start to process the orders as soon as possible. The processing days required cannot be subject to any strict expire date, whether the shipment of the Work, or the pickup of the damaged Work is concerned.

The Gallery will not be responsible for courier’ delays due to fortuitous events, force majeure and, more generally, to external causes and not dependent on the Gallery itself.

 

7. THE TERMINATION RIGHT BY THE CUSTOMER  

Pursuant to Article 59, lett. c) of the Consumer Code, the termination right by the customer is excluded because the purchase, whether or not was made at the Gallery, located in Via Augusto Dulceri 46, 00176 Rome, involves a Work having a customised-package. 

 

8. MISCELLANEOUS

Once the Customer has come into material possession of the Work, he/she will make use of it in full compliance with Law 22 April 1941, n. 633 and the Civil Code that regulates the topic, obliging him/her to keep the Gallery free from any claim made by third parties as a result of the abuse and/or wrongful use of the Work by the Customer.

If the Customer is a minor or affected by any impediment that can invalidate his/her legal capacity, the procedure for confirming the purchase order of the Work must be carried out with the assistance of a parent or a legal tutor, who will in fact be the only responsible parties since the Gallery is not in the position to carry out any preliminary verification.

If for any reason, any provision contained in these General Conditions is or becomes illegal, void or invalid, such invalidity shall not affect the rest of these General Terms and Conditions.

The Gallery shall not be liable, in any case, for any data that the Customer will inserts in the Site which may be untrue, contrary to the law, including privacy and processing of personal data rules, mandatory regulations, public and morality order too. For these reasons, the Customer, will assume all the responsibilities of the case, keeping the Gallery indemnified from any claims made by third parties. 

 

9. APPLICABLE LAW AND COMPETENT COURT

These General Conditions and the use of the Site are governed by Italian law.

For any dispute concerning the interpretation or execution of these General Conditions and of the contract for the purchase of the Work, the Court of Rome shall have jurisdiction, to the exclusion of any other alternative and competing jurisdiction.
